Terms and Conditions Policy
These terms and conditions represent a legally binding contract between the client or employer (the “Client”) and Nannies des Maisons (the “Agency”). The verbal or written instruction by the Client to the Agency to submit suitable Candidates for contact, interview, or arrangement of interviews constitutes acceptance of these terms and conditions. The term “Candidate” refers to any person introduced by the Agency. The Agency acts solely as an independent introduction agency.
The engagement of any employee will be regarded as acceptance of the conditions set out below:
1. Nannies des Maisons provides suitable candidates on an introduction‑to‑employment basis only and cannot be held responsible for any conflicts, issues, or disputes arising from the Client’s decision to employ a Candidate. A non‑refundable registration fee of £249.00 applies for clients using our Signature Membership Concierge Service. No registration fee applies to standard registrations.
2. The Client agrees to notify Nannies des Maisons immediately when an engagement is agreed and accepted, and to pay the applicable fee (as set out in our fee structure) within 1 week of the invoice being issued, or before the nanny commences employment if sooner. In cases of non‑payment, a recovery charge may be applied. An invoice will be issued once employment has been agreed verbally or in writing.
3. Introductions are confidential. If the Client refers a Candidate introduced by Nannies des Maisons to a third party who subsequently engages that Candidate, the Client will be liable for the applicable introduction fee. “Introduction” includes the passing of a CV or any identifying information that leads to an engagement.
4. No refund will be payable if the employee leaves during the probation period due to changes in the working environment, duties, or conditions, or due to mistreatment of the employee.
5. If a Candidate does not attend or fails to inform the Client or the Agency, and a replacement cannot be found within 1 month, a full refund will be issued if payment has already been made.
6. If employment is terminated due to the Client’s change of mind after the Candidate has commenced work (temporary or permanent), fees paid will not be reimbursed.
7. If an offer of employment is withdrawn by the Client before the Candidate commences work, the Client is liable to pay 50% of the introduction fee, which will be deducted from the invoice amount.
8. Where temporary employment is extended, an additional invoice will be issued to cover the extended period. Employment exceeding 12 weeks will be classed as permanent unless otherwise agreed.
9. The Client is responsible for all National Insurance, taxation, and employment obligations relating to any Candidate they engage. For overseas roles, the Client must comply with all local employment laws and tax requirements.
10. Nannies des Maisons acts as an introduction agency only. While reasonable efforts are made to verify references and vet Candidates, the Agency cannot guarantee the suitability of any Candidate. Clients are strongly advised to conduct their own checks where necessary.
11. Nannies des Maisons shall not be liable for any loss, expense, damage, delay, or compensation (direct or indirect) arising from the introduction or engagement of any Candidate, or from the failure to introduce a Candidate. This does not exclude liability for death or personal injury resulting from the Agency’s negligence.
12. Nannies des Maisons does not employ staff directly. All tax, National Insurance, and employment responsibilities rest with the Client. Clients are advised to seek guidance from HMRC or a tax professional.
13. Nannies des Maisons recommends that Clients ensure any employee engaged has valid Public Liability Insurance with a minimum indemnity of £1,000,000.
14. Insurance & Liability
At Nannies des Maisons, we uphold the highest standards of safety, professionalism, and due diligence. Our insurance framework is designed to protect families, nannies, and the integrity of our service at every stage of the placement journey.
Agency Insurance
Nannies des Maisons maintains comprehensive insurance cover to support the responsible operation of our agency, including:
- Professional Indemnity Insurance — protects against claims relating to advice, vetting, or placement recommendations.
- Public Liability Insurance — covers incidents occurring during agency activities, meetings, or assessments.
- Cyber & Data Protection Insurance — safeguards the personal data entrusted to us and supports our GDPR‑aligned processes.
- Legal Expenses Insurance — provides support in the event of contractual or operational disputes.
Where applicable, we also maintain Employers’ Liability Insurance in accordance with UK law.
Nanny Insurance Requirements
All nannies represented by Nannies des Maisons must hold appropriate insurance before commencing a placement. If the family does not wish to uphold this standard, this is at the families or clients own responsibility.This includes:
- Public Liability Insurance (mandatory for Ofsted‑registered nannies)
- Business‑use car insurance if transporting children
- Any additional cover relevant to their role, such as personal accident or travel insurance for international placements
We verify insurance documentation during onboarding and at regular intervals to ensure ongoing compliance.
Client Responsibilities
Families employing a nanny are responsible for ensuring they hold:
- Employers’ Liability Insurance (a legal requirement for all UK employers)
- Any additional household or travel insurance relevant to the nanny’s duties
Nannies des Maisons provides guidance to support families in meeting these obligations.
Refunds are only payable to Clients who have settled their invoice within 7 days (as stated in clause 2) and who provide written confirmation of termination within 7 days.
